B2B Terms and conditions

1. General Information
Sales from www.marlic-steering.com are conducted by Marlic A/S, Mejerigaden 12, 3730 Nexø, Denmark, CVR no.: DK28147104. If you encounter any issues with your order on the website or while using the website, please contact our customer service at:

Please note that we do not offer retail sales from the company address.

 

2. Contract Formation
A legally binding agreement between you and Marlic A/S is not concluded until you receive an invoice. Until you receive the invoice, Marlic A/S reserves the right to cancel your order in whole or in part, e.g., due to pricing or text errors or sold-out items, in which case you will be notified by email.
When you place an order on our Online Store, you will automatically receive an email listing the items you have requested. This email is merely an electronic receipt confirming that we have received your order request, and a legally binding agreement between you and Marlic A/S has not yet been concluded at this point. The legally binding agreement will only be concluded, when you receive the invoice.

 

3. Ordering
The online store is open 24 hours a day but may be closed due to maintenance. Orders are processed and dispatched Monday through Friday. Orders placed on public holidays will be processed the following business day. It is not possible to order items for collection. Marlic A/S has no showroom and does not offer retail sales at the company address.

 

4. Payment
We offer invoice payment only when ordering at www.marlic-steering.com.

Payment Procedure
When we receive your order, it will be reviewed by Marlic A/S. Upon approval of your order, Marlic A/S will issue an invoice for the ordered goods/services.

Payment Terms
Once we have received your full payment of the issued invoice, your order will be packed and dispatched from our warehouse within one business day.

Prices
All prices for goods, delivery costs, and other costs listed are inclusive of taxes, VAT, and duties. Costs related to delivery, shipping, or postage may vary and will be added to each order.

Currency
All payments are made in Euros (EUR).

 

5. Delivery
We deliver to addresses within the EU.
Our goods are shipped via an appropriate carrier according to your chosen delivery address. This may include GLS, PostNord, FedEx, or similar services.
 

Delivery Terms
Physical goods will be delivered to the delivery address specified at the time of order. Digital goods (e.g., manuals) will be sent as a link in the order confirmation. Certain items are subject to special delivery conditions. These conditions will be specified prior to the purchase of such items. Goods are delivered on all business days. Items in stock are typically delivered within a few business days of the order, depending on the country of delivery. If an item is out of stock or there is a change in the estimated delivery time, customer service will contact you as soon as possible. Please note that you assume the risk for the goods once delivery has been made. Delivery is considered complete when the goods are in your possession. If the packaging appears to be damaged, you should refuse to accept the item.

Separate Deliveries
If your order consists of multiple items, we reserve the right to make separate deliveries. Separate deliveries may be necessary if certain items are delayed or out of stock at the time of order, or if the items are stored and dispatched from different locations. You will not be charged additional delivery costs for separate deliveries.

Collection of Goods
It is not possible to collect goods at our address. Marlic A/S has no showroom and does not offer retail sales at the address.

Shipping Prices
We offer free delivery within the EU on all orders above 50 EURO. Orders under 50 EURO will be charged for delivery as specified at checkout. Any return shipping costs will be charged according to the actual shipping cost of the returned goods.

 

6. Right of Withdrawal
As a business customer, you do not have the same right of withdrawal as a consumer under the EU Consumer Rights Directive. However, we offer a discretionary 14-day right of withdrawal under the following conditions:
- The goods must be returned in their original condition and packaging.
- You must notify us of your intent to return the goods within 14 days of receipt.
- The cost of return shipping is borne by you.
 

Goods made to your specifications or personalized goods are exempt from the right of withdrawal.

Return
Once you have notified us of your wish to withdraw, you have 14 days to return the item to us. You must bear the direct costs of returning the item. You are responsible for the item from the time of delivery.
We do not accept packages without delivery or packages sent cash on delivery.

7. Warranty Statement
a: The equipment manufactured by Marlic A/S (The “Warrantor”) is warranted to be free from defects in workmanship and materials under normal use and service.

b: This Warranty is in effect for two years (Leisure Use) or one year (Commercial use) from the date of purchase by the user. Proof of purchase must be included, to establish that it is inside the warranty period.

c: This Warranty is transferable and covers the product for the specified timeperiod.

d: In case any part of the equipment proves to be defective, other than those parts excluded in paragraph 5 below, the owner should do the following:

  1. Prepare a detailed written statement of the nature and circumstances of the defect, to the best of the Owner’s knowledge, including the date of purchase, the place of purchase, the name and address of the installer, and the Purchaser’s name, address and telephone number;
  2. The Owner should return the defective part or unit along with the statement referenced in the preceding paragraph to the warrantor, Marlic A/S or an authorized Service Centre, postage/shipping prepaid and at the expense of the Purchaser;
  3. If upon the Warrantor’s or Authorized Service Centre’s examination, the defect is determined to result from defective material or workmanship, the equipment will be repaired or replaced at the Warrantor’s option without charge, and returned to the Purchaser at the Warrantor’s expense;
  4. no refund of the purchase price will be granted to the Purchaser, unless the Warrantor is unable to remedy the defect after having a reasonable number of opportunities to do so. Prior to refund of the purchase price, Purchaser must submit a statement in writing from a professional boating equipment supplier that the installation instructions of the Installation and Operation Manual have been complied with and that the defect remains;
  5. warranty service shall be performed only by the Warrantor, or an authorized Service Centre, and any attempt to remedy the defect by anyone else shall render this warranty void.

e: There shall be no warranty for defects or damages caused by faulty installation or hook-up, abuse or misuse of the equipment including exposure to excessive heat, salt or fresh water spray, or water immersion except for equipment specifically designed as waterproof.

f: No other express warranty is hereby given and there are no warranties which extend beyond those described in section 4 above. This Warranty is expressly in lieu of any other expressed or implied warranties, including any implied warranty of merchantability, fitness for the ordinary purposes for which such goods are used, or fitness for a particular purpose, and any other obligations on the part of the Warrantor or its employees and representatives.

g: There shall be no responsibility or liability whatsoever on the part of the Warrantor or its employees and representatives for injury to any person or persons, or damage to property, loss of income or profit, or any other consequential or resulting damage or cost which may be claimed to have been incurred through the use or sale of the equipment, including any possible failure or malfunction of the equipment, or part thereof.

h: The Warrantor assumes no liability for incidental or consequential damages of any kind including damages arising from collision with other vessels or objects.

i: This warranty gives you specific legal rights, and you may also have other rights which vary from country to country.

 

8. Complaint Procedure
You must always complain within a reasonable time after discovering the defect. If you complain within two months after the defect is discovered, the complaint will always be timely.
You can complain by contacting customer service at info@marlic.dk. When contacting customer service, you must provide the order number, invoice number, and possibly the item number, and describe what is wrong with the item. If possible, please also attach a picture of the item showing the defect.
If the complaint is justified, we will refund your (reasonable) shipping costs for returning the item to us. Otherwise, you must bear all costs of transportation, including our shipping costs for returning the item after inspection.
Remember that the item must always be sent in proper packaging and remember to get a receipt for the shipment. You are responsible for the package/items until we receive them. Therefore, keep the postal receipt including information on shipping costs and possibly the tracking number.
Note! We do not accept packages without delivery or sent cash on delivery.

 

9. Data Protection Policy (Extract - for full Privacy Policy click here)
To enter into an agreement with us, we need the following information from you: Business Name, VAT-number, contact name, address, phone number, and email address. We register your personal information with your consent and for the purpose of delivering the goods to you. We also use your information for marketing and competitions if you have subscribed to our newsletter and given consent for this. Personal data is registered with Marlic A/S and stored for 5 years, after which the information is deleted. The information is also shared with the external distributor (e.g., GLS or PostNord, etc.) so they can deliver your order to the desired destination.
In cases of suspected fraud, we may need to investigate the matter, and in such a situation, we will use your information.
As a registered customer with Marlic A/S, you always have the right to object to the registration. You also have the right to access the information registered about you. You have these rights under the Data Protection Act (Persondataloven), and inquiries in connection with this should be directed to Marlic A/S via email: info@marlic.dk.

When you use our website, we use cookies. A cookie is a text file stored on your device to improve your user experience (remembering log-ins, if there are products in the cart, etc.). If you wish to remove cookies, you can do so through the settings in your web browser. Please note that it may affect the functionality of our website if you disable cookies.

 

10. Miscellaneous
Website Updates
We do our best to update the website and ensure that prices, offers, descriptions, and other information about the goods are correct. However, errors in prices, offers, descriptions, and other information about the goods, as well as spelling errors, can occur, and sometimes we find that the price of a good is incorrectly stated. If we discover an error in the price of an item you have ordered on the website, we will notify you as soon as possible. Under these circumstances, we will inform you of the correct price of the item and offer you the opportunity to purchase the item at the correct price. If we are unable to contact you, we will exercise our right not to cancel the order.

Force Majeure
We are not responsible for delays or failure to fulfill our obligations under these terms if the delay or failure is due to force majeure.

Invalidity
If one or more of the terms in these Terms and Conditions is declared wholly or partially invalid, the remaining provisions shall continue to apply.

 

11. Maritime and Commercial Law
Any dispute arising out of or in connection with these terms and conditions, including disputes regarding the validity, interpretation, or enforcement of the agreement, shall be governed by Danish law, including the rules of the Maritime and Commercial Court (sø- og handelsretten).
In the case of international trade, and if the parties cannot reach an agreement, the matter shall be brought before the Maritime and Commercial Court in Copenhagen unless Marlic A/S chooses to bring the case before the local court where the buyer is domiciled.
If the matter concerns the transport of goods across international borders, the relevant international convention (e.g., the CMR Convention for road transport) and Danish legislation, including the Maritime Act, shall apply.

 

12. Complaints
If you wish to lodge a complaint about your purchase, please contact Marlic A/S customer service at info@marlic.dk. If we are unable to resolve the issue, you may file a complaint with the relevant trade or arbitration body in your jurisdiction.

 

13. Export to  the USA, Canada & Norway

  1. Scope of Application
    These terms and conditions apply to all sales and deliveries from Marlic A/S (hereinafter referred to as the "Seller") to customers in the United States and Canada (hereinafter referred to as the "Buyer"). These terms are an addition to and take precedence over the general terms and conditions of sale, unless otherwise agreed in writing.

     

  2. Delivery Terms
    All deliveries from the Seller to the Buyer are made in accordance with Incoterms® 2020. Unless otherwise agreed in writing, the goods are delivered DAP (Delivered At Place) to the address specified by the Buyer. The Buyer is responsible for all costs related to customs clearance, import duties, and local taxes, as well as any further transportation beyond the agreed delivery point.

     

  3. Product Certification
    The Seller guarantees that the steering components comply with the following safety and performance standards, unless otherwise stated: 

    CE Certification: The Marlic Steering System is CE-certified via EU-Type Examination under ISO 10592 and ISO 8846 and has been approved for the EU market. 

    ABYC Certification: The Marlic Steering System is also certified to the ABYC P-21 standard, thereby approving it for the North American market.

     

  4. Customs and Import Regulations
    The Buyer is responsible for ensuring that the imported goods comply with local laws, regulations, and safety standards in the destination country. The Seller assumes no liability for delays caused by customs clearance or import restrictions that the Buyer has not fulfilled. The Buyer is also responsible for handling and paying any customs duties, taxes, and other import fees that may apply upon entry into the USA or Canada.

     

  5. Product Liability and Insurance
    The Seller guarantees that the goods comply with relevant EU standards and are properly packaged for international transport. The Seller assumes liability for the goods until they are delivered to the Buyer at the agreed place of delivery in accordance with DAP (Delivered At Place) Incoterms® 2020. Once the goods are delivered, the risk of loss or damage passes to the Buyer. The Seller assumes no liability for claims or damages arising from local requirements in the USA or Canada that differ from EU regulations.
    The Buyer is responsible for ensuring that appropriate insurance is in place to cover import-related risks, including customs clearance and any further transportation beyond the agreed delivery point.

     

  6. Payment Terms
    Payment must be made in accordance with the terms specified in the order confirmation. Delayed payments may result in delivery delays and the imposition of late fees and interest in accordance with applicable law.

     

  7. Export Restrictions
    The Buyer declares that the goods will not be exported to countries or entities subject to sanctions or trade restrictions imposed by the EU, the EFTA, the USA, or Canada without first obtaining the necessary export licenses.
